The terms that govern your use of CropMap Namibia.
These Terms & Conditions (the “Terms”) govern your access to and use of CropMap Namibia (the “Service”, “CropMap”), a sponsored service provided by QBatic (the “Operator”, “we”, “us”, or “our”) at cropmap.qbatic.com. By accessing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Acceptance of these Terms
By creating an account, submitting data, or otherwise using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf.
2. Definitions
- “Content” means any data, figures, text, or other material submitted to or displayed through the Service.
- “User Content” means Content you submit, including profile details, storage and field information, silo levels, and movement records.
- “Aggregated Data” means regional and national figures derived from User Content that do not identify any individual participant.
- “Producer” means a registered farmer account; “Mill” means a registered mill-operator account.
3. Nature of the Service
CropMap is an informational visibility tool. Its purpose is to give a regional and national picture of how much produce is available on farms and held at mills, and how it is moving over time. The Service:
- relies on figures that are self-reported by participants;
- presents information only in aggregated, regional or national form to the public;
- is not a marketplace, exchange, broker, or transaction platform, and does not facilitate, guarantee, or settle any sale, purchase, or delivery of crops;
- does not constitute official statistics, agricultural advice, financial advice, or trading advice.
4. Independence and no affiliation
CropMap is a sponsored service provided by QBatic. It is independent and is not affiliated with, endorsed by, or acting on behalf of any farmer organisations, Namibian agricultural institutions, milling companies, or the Government of the Republic of Namibia. Any reference to such bodies is for descriptive or contextual purposes only and does not imply any partnership, sponsorship, or endorsement.
5. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, and able to form a legally binding contract, to register for or use the Service. By registering you represent that the information you provide is accurate and that you are entitled to provide it.
6. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to keep it up to date. You must notify us promptly of any unauthorised use of your account. We are not liable for any loss arising from your failure to safeguard your credentials. You may not share, sell, or transfer your account without our consent.
7. Your data and accuracy
You are solely responsible for the User Content you submit and for ensuring it is accurate, lawful, and not misleading. Because the Service depends on self-reported figures, you agree to report in good faith and to correct or update your figures as circumstances change (for example, by recording sales, harvests, production, and silo adjustments). You must not deliberately submit false, inflated, or fraudulent figures, or figures relating to property or operations that are not yours.
8. Acceptable use
You agree that you will not, and will not attempt to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- submit false, misleading, or deceptive information;
- impersonate any person or organisation, or misrepresent your affiliation with any person or organisation;
- access, scrape, harvest, or extract data by automated means, or attempt to obtain non-public or individual-level data about other participants;
- interfere with, disrupt, probe, or compromise the integrity or security of the Service or its underlying systems;
- upload viruses or malicious code, or attempt to gain unauthorised access to any account, system, or network;
- use the Service in any way that infringes the rights of others or violates any applicable law or regulation.
9. No reliance & disclaimer of warranties
The Service and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Figures shown are indicative estimates derived from self-reported data and may be incomplete, out of date, or inaccurate. They are not official statistics and must not be relied upon as the sole basis for any commercial, trading, financial, planning, or other decision. You use the Service and any Content at your own risk and are responsible for independently verifying any information before acting on it.
10. Intellectual property and licence
The Service, including its design, software, layout, text, graphics, and the compilation of all Content (excluding User Content), is owned by or licensed to the Operator and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose.
You retain ownership of your User Content. By submitting User Content, you grant the Operator a worldwide, royalty-free licence to host, store, reproduce, and process that Content for the purpose of operating and providing the Service, including the right to generate and publish Aggregated Data. You represent that you have the rights necessary to grant this licence.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service you consent to that processing. The Service is designed to protect individual participants through location privacy, regional aggregation, and a minimum-reporting threshold, as described in the Privacy Policy.
12. Third-party services and links
The Service may rely on or link to third-party services (for example, map tiles, charting libraries, and hosting). We do not control and are not responsible for the content, policies, or practices of any third party, and your use of them may be subject to their own terms.
13. Availability and changes
We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We may also update these Terms from time to time; when we make material changes we will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
14. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, at any time and without liability, if we reasonably believe you have breached these Terms, submitted false data, or used the Service in a manner that may cause harm or legal exposure. You may stop using the Service and request deletion of your account at any time. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and governing law — will survive.
15. Limitation of liability
To the maximum extent permitted by law, the Operator and its sponsors, partners, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of (or inability to use) the Service or any Content, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us to use the Service (if any) in the twelve months preceding the claim, or NAD 1,000. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
16. Indemnity
You agree to indemnify and hold harmless the Operator and its sponsors, partners, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your User Content, your use of the Service, or your breach of these Terms or of any applicable law or the rights of any third party.
17. Governing law
These Terms are governed by and construed in accordance with the laws of the Republic of Namibia, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of Namibia in respect of any dispute arising out of or in connection with these Terms or the Service.
18. General
- Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and the Operator regarding the Service and supersede any prior agreements.
- Severability: if any provision is found unenforceable, the remaining provisions will continue in full force and effect.
- No waiver: our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a reorganisation, merger, or transfer of assets.
